The contract should specify the employee's job duties, salary, and benefits.
In addition, employers need to withhold taxes from their employees' salaries and make social security contributions on their behalf under a ‘Pay As You Earn’ system.
Employers also need to comply with safety and health regulations in the workplace.
The specifics for businesses hiring talent in Uruguay include:
Payroll
- All Uruguayan employees are paid in Uruguayan pesos
- Employees work between 44 hours and 48 hours per week
- Uruguayan law requires that employers provide their workers with a minimum wage, as well as health insurance and other benefits
- The tax rate in Uruguay ranges from 0% to 36%. This rate applies to both local and foreign employees
- Employers pay 12.625% of staff salary into pension and medical funds, while employees pay between 18.1% and 23.1%
- All staff must be registered with the Banco de Previsión Social (BPS).
Employers also need to be aware that the country has a tradition of paying an ‘Aguinaldo’. This is a bonus payment and is the equivalent of a month’s pay and is paid in two installments — in June and December.
Leave
- Uruguay has 12 national holidays and most businesses are closed on these days
- Uruguayan workers are entitled to 20 vacation days per year and this increases by one day for every five years of service (up to 25 days)
- Employees are entitled to up to one year of sick leave and, in special circumstances, up to 2 years
- Employers pay sick pay for the first three days and then employees are paid through the BPS. Maternity pay is also paid via the BPS.
- Women are entitled to 14 weeks of maternity leave. Six are taken before the baby’s due date and eight weeks are taken afterward
- Dads and partners are also entitled to 13 days of paid paternity leave.
Taxes
Employee income taxes in Uruguay are:
- 0%: 0-409,080 Uruguayan Pesos (UYU)
- 10.00%: 409,080 UYU to 584,400 UYU
- 15.00%: 584,400 UYU to 876,600 UYU
- 24.00%: 876,600 UYU to 1,753,200 UYU
- 25.00%: 1,753,200 UYU to 2,922,000 UYU
- 27.00%: 2,922,000 UYU to 4,383,000 UYU
- 31.00%: 4,383,000 UYU to 6,720,600 UYU
- 36% on anything over 6,720,600.
Employees must also pay a proportion of their salary to:
- Retirement: 15% (Employers pay 7.5% into this fund).
- Health insurance: 3% to 8% (Employers pay 5%)
- Labor Restructuring Fund: 0.1% (Employers pay 0.1%)
- Labor Credit Guarantee Fund: 0% (Employers pay 0.025%).
In total, employees pay between 18.1% to 23.1% of their salary in extra taxes.
